Menendez brothers’ resentencing moved to January

Incoming Los Angeles District Attorney Nathan Hochman will have an opportunity to review the case before the resentencing hearing.

Lyle and Erik Menendez, who have been in prison for over 30 years for killing their parents, are seeking resentencing which could potentially lead to their release, subject to judge and parole board approval.

The brothers testified at their hearing and had family members, both supporting and opposing their release, provide testimony as well.

The big picture: Current Los Angeles County District Attorney George Gascón recommended resentencing the brothers for a lower penalty, citing their rehabilitation efforts in prison.

What we’re watching: The resentencing hearing has been delayed until January 30th, allowing the new district attorney, Nathan Hochman, to review all facts before making a decision on whether to support the resentencing effort.

  • If resentencing is approved, the case will move to a parole board for further evaluation. Other potential routes to freedom for the brothers include a clemency request and a habeas corpus petition, both of which could result in their release if successful.
