Valley Children’s Hospital has settled a lawsuit with a Madera County couple, who sued the hospital over a large mound of dirt left next to their home during a construction project, as first reported by GV Wire’s David Taub.
The couple claimed that the dirt blowing into their home negatively impacted their quality of life.
Driving the news: The trial that was scheduled to start last week was canceled due to the settlement. Although the plaintiffs did not disclose the terms of the agreement, a spokesperson from Valley Children’s Hospital revealed the details. The hospital has agreed to purchase the plaintiffs’ home for its appraised value, plus a percentage.
- As part of the settlement, Hamilton and Shimler will be allowed to live in the house rent-free for six months while they search for a new residence.
- Valley Children’s Hospital plans to incorporate the land into its future campus growth.
- The settlement is still pending court approval.
