Class action lawsuit filed against Fresno area food packager 

Maxco Supply, Inc. allegedly failed to pay overtime wages for the last four years, along with not paying out vacation days for former employees.

A Fresno area food packager is being sued by current and former employees for unpaid wages and bad labor practices. 

Former  employee Abdon Elizondo III filed a class action lawsuit against Maxco Supply, Inc. in June alleging 10 complaints, including failure to pay overtime wages and failure to pay minimum wage. 

Driving the news: Maxco has three plants south of Fresno in Fowler, Parlier and Reedley and has provided packaging design and manufacturing for over 40 years. 

The big picture: Elizondo claims in the lawsuit that for at least four years before filing the complaint, Maxco failed to pay overtime wages and had employees work off the clock, among other issues. 

  • The 10 class action complaints in full are failure to pay overtime wages, failure to pay minimum wages, failure to provide meal periods, failure to provide rest periods, waiting time penalties, wage statement violations, failure to timely pay wages, failure to indemnify, violation of state labor code and unfair competition. 
  • Elizondo believes that there are over 75 class members employed by Maxco. 

Go deeper: The lawsuit claims that Maxco edited and manipulated employees’ time entries by rounding their entries down, resulting in lower pay. 

  • Maxco also allegedly failed to pay split shift premiums. 
  • For employees who resigned from Maxco or were let go, the company allegedly had a consistent policy of failing to provide employees with compensation at their final rate of pay for unused vested paid vacation days, violating state labor code. 

What we’re watching: Elizondo is demanding a trial by jury on all causes and is asking for damages for all owed wages.
