Convicted murderer Scott Peterson’s hopes to get out of prison were given a boost.

The California Supreme Court ordered a trial judge in the San Mateo County Superior Court to consider if Peterson should receive a new trial.

That’s the second time in the last few months the state’s highest court has worked in Peterson’s favor.

In August, the California Supreme Court overturned Peterson’s death sentence, which he had been given after being convicted of murdering his wife and unborn son.

According to the Los Angeles Times, the state Supreme Court said a juror in Peterson’s trial had committed “prejudicial misconduct” by failing to disclose her previous legal proceedings, which included a lawsuit to obtain a restraining order after her boyfriend’s ex-girlfriend harassed her while she was pregnant.

The state Supreme Court’s ruling comes in response to Peterson’s 2015 petition for habeas corpus.
