Trump asks Supreme Court to give DOGE access to Social Security

Social Security data could be granted to DOGE if the Supreme Court rules in favor of the Trump administration.

The Trump administration has requested the Supreme Court to permit Elon Musk’s Department of Government Efficiency (DOGE) to access Social Security systems that contain personal information of millions of Americans. 

This appeal follows a judgment in Maryland that had limited DOGE’s access to Social Security data under federal privacy laws, encompassing a wide array of personal records such as school history, financial details, salary information, and medical records.

The big picture: The administration argues that DOGE requires access to identify and eradicate waste within the federal government, particularly focusing on Social Security, which Musk views as a source of significant fraud. 

  • Musk has labeled the Social Security system as a “Ponzi scheme” and emphasized that reducing inefficiencies could lead to substantial savings in government expenditure.
  • Solicitor General John Sauer voiced concerns that the limitations imposed by the judge disrupt DOGE’s critical mission and intrude on the prerogatives of the executive branch. He warned that upholding the injunction would likely lead to further judicial encroachments into internal agency operations.
  • In response to the judge’s order in Maryland, the government has sought the Supreme Court’s intervention. The Trump administration has indicated that DOGE’s efficacy would be impeded by constraints on data access and that the court’s ruling risks normalizing risky practices in handling sensitive information.

Driving the news: The lawsuit instigating these legal battles was initiated by a coalition of labor unions and retirees, represented by Democracy Forward. The Supreme Court has requested their response to the administration’s appeal by a specified deadline.
